“Both Burundi and South Africa announced in the last two weeks that they intend to withdraw from the jurisdiction of the International Criminal Court (ICC). On October 12, 2016, 94 of 110 parliamentary members in Burundi voted in support of retracting Burundi’s membership as a State party to the ICC’s treaty, the Rome Statute. [ICC Press Release] On October 18, 2016, the president of Burundi signed legislation withdrawing the country from the ICC. [NY Times: Vote] Three days later, South Africa announced its plans to withdraw from the ICC; the country sent an official notice to the United Nations earlier in the week. [Washington Post] Withdrawal takes effect a year after official notice is provided to the UN Secretary General. The Special Litigation Section (SPL or Section) is one of several Sections in the Civil Rights Division. SPL is seeking an experienced attorney for the position of Deputy Chief. The attorney selected for this position will be dedicated to the Section’s work pursuant to the Health Care Fraud and Abuse Control (“HCFAC”) program, with an emphasis on the Section’s matters that seek to enforce compliance with the integration mandate of the Americans with Disabilities Act, as interpreted by the Supreme Court in Olmstead v. L.C., 527 U.S. 581 (1999). More specifically, most of the incumbent’s work will be devoted to supervising the investigation, negotiation, and litigation of matters involving the unnecessary segregation or the risk of unnecessary segregation of individuals with disabilities in institutions. Northwest Immigrant Rights Project Seeking Fall Intern/Extern, Due 8/7

NWIRP’s Seattle Office services low-income immigrants and refugees in Western Washington. The office provides direct legal representation, referrals to pro bono attorneys, pro se assistance, and workshops on immigration matters ranging from asylum, citizenship, family petitions, and protections for immigrant children and victims of crimes.

The internship is open to first, second, and third year law students. Applicants should have excellent written and oral communication skills, an interest in immigration law, an ability to work in a diverse and fast-paced work environment, and a commitment to advancing and defending the legal rights of low-income immigrants and refugees. Applicants proficient in Spanish are strongly preferred. The internship is unpaid, but NWIRP will work with applicants to secure outside funding or academic credit.

The Center for Reproductive Rights (the Center) is the premier global legal organization dedicated to advancing women’s reproductive health, self-determination, and dignity. The Center’s U.S. Policy and Advocacy (USPA) department is looking for an enthusiastic, resourceful and highly organized law student intern with a commitment to reproductive rights issues to engage in a variety of projects related to federal policy analysis and nonprofit advocacy. This internship will provide the successful candidate with experience in the day-to day operations of a dynamic in-house federal policy team, including legislative analysis and drafting, coalition advocacy, and translating legal and legislative language into persuasive policy documents.

The internship is part-time, and will begin in September 2015 and end in November 2015. Exact schedule is flexible according to the student’s academic schedule, but preference will be given to candidates that are available for a minimum of 15 hours/week spread over multiple days. Washington Defender Association (WDA) Immigration Project: WDA’s Immigration Project seeks two externs for Winter and Spring Quarters 2015 to research the immigration consequences of various convictions and work preparing publications and training programs for defense attorneys, prosecutors, and the court. WDA provides constitutionally mandated advice to attorneys across Washington on whether their non-citizen clients will face immigration consequences as a result of their convictions.  Students working in this rapidly evolving area must have taken immigration law and/or be taking criminal procedure (or have equivalent experience).  Students must work at the field placement for 16 – 20 hours/week. Regardless of how many externship credits students seek, students must also enroll in the two-credit immigration seminar (Legislation and the Formulation of Public Policy) offered by Professor Angelica Chazaro in Winter Quarter 2015. B512 Legislation and the Formulation of Public Policy
This course will examine immigration laws and policies related to how removal (deportation) laws and policies are established and implemented, and including the emergence and role of social change movements. Topics will include the intersection of immigration and criminal law, border security, state and local enforcement, the root causes of unauthorized migration, and the challenges of immigration law reform. The course will cover both legal doctrine and legislative issues concerning immigration detention and enforcement.

TeamChild Seeking Juvenile Record Sealing Legal Intern, Paid Position, Due 12/5

The Juvenile Record Sealing Legal Intern is responsible for assisting young men and women with motions to seal their juvenile record. The Intern will be responsible for running two juvenile record sealing clinics in King County. The clinics occur one Wednesday and one Saturday a month, October-May and two or three summer clinics. The intern’s attendance at these clinics is mandatory. The Intern will be responsible for organizing outreach efforts to ensure attendance at the Clinic and coordinating the participation of attorney and student volunteers.

Following the clinics, the Intern will be responsible for the filing and processing of paperwork necessary to seal juvenile criminal history. This requires the intern to be present at the King County juvenile courthouse two Fridays a month. The Intern will also be responsible for publicizing the Juvenile Record Sealing Clinics in King County and responding to calls and emails seeking general information regarding the record sealing process. The intern will also be asked to gather information on current juvenile offenders.

A successful applicant will be a law student in good academic standing. The position requires someone who is self-motivated and has an excellent demeanor with clients and colleagues. This position is open to both work study and non work study qualified students. The time commitment is approximately 20-30 hours per month and the rate of pay is $18 an hour. The intern must be able to attend the sealing clinics (1st Wednesday of every month from 6-8 PM and 1 Saturday every month from 9:00-11:00 AM) and the King County Juvenile Court hearing (at least one morning a month from 8:30-11:30 AM). A car is useful but not necessary.

Accountability Counsel defends the environmental and human rights of communities around the world who are harmed by internationally financed development projects. We specialize in non-judicial accountability mechanisms established to receive community complaints. We accomplish our mission through: (1) assisting communities to use these mechanisms effectively and; (2) policy advocacy, ensuring that these complaint offices are accessible, transparent, and fair tools for justice.

Our Law Fellows will support Accountability Counsel’s collaboration with communities around the world in their complaints to accountability mechanisms, as well as policy work toward improvement of accountability mechanisms. Law Fellows will work on legal research assignments and fact memos, and will participate in meetings with community members, international institutions, and NGO colleagues. The full-time UN Advocacy Officer performs advocacy, outreach, training and research duties in the context of the United Nations, as well as other tasks, according to the needs of the organization and its partners. As the UN Advocacy Officer you will be working with a small team of co-workers within the Geneva Office of CIHRS, as well as with a larger team of program and CIHRS staff located in multiple countries. Lindsay Civil Rights Fellowship Program. The Lindsay Fellowship provides an opportunity for recent law school graduates to become familiar with civil rights practice by working with many of the nation’s leading civil rights experts at the national office of the Lawyers’ Committee in Washington, D.C. Pilot Introduction and Evaluation of Sayana Press is a four-year project funded by the Bill and Melinda Gates Foundation. Sayana Press (SP) is an innovative subcutaneous injectable contraceptive. The project will facilitate the introduction of Sayana Press in four countries:  Senegal, Burkina Faso, Niger and Uganda. The project aims to make Sayana Press available through routine health service delivery channels and build the evidence base for global decision-making about whether and how to include Sayana Press in family planning programs in the future. Looking beyond the current introductions, the project also plans to work closely with ministries of health in Senegal and Uganda to build the evidence base on issues such as the operational feasibility and cost-effectiveness of Sayana Press self-injection among women.

Breaking News! Highest U.S. Immigration Tribunal Recognizes Domestic Violence as a Basis for Asylum

The Board of Immigration Appeals (BIA) today issued a landmark ruling, Matter of A-R-C-G-, with the potential to affect immigrant women across the country. As CGRS has done with so many asylum cases based on domestic violence, we assisted the attorney in this case (Roy Petty) with briefing and strategy, and we filed an amicus brief in support of the client.

CGRS has pioneered this area of the law in two internationally known cases – starting with the case of Rody Alvarado, Matter of R-A-, and then in Matter of L-R-. CGRS Director Karen Musalo, working with her colleagues at CGRS, represented both women. In 2004, and again in 2009, the Department of Homeland Security (DHS) set forth its position that women fleeing intimate partner violence can qualify for asylum and agreed to grants of asylum in R-A- and L-R-, respectively. These were important victories, signaling that these cases are viable, but they did not set precedent. Now, for the first time, we have binding precedent to support domestic violence survivors who seek protection in the United States.

CERD Issues Its Concluding Observations on the United States

The U.N. Committee on the Elimination of Racial Discrimination has issued its Concluding Observations on U.S. compliance with the CERD treaty, reflecting many of the concerns raised by the delegation of U.S. civil and human rights groups that came to Geneva to testify.  We were especially pleased to see the strong recommendations (pp. 6-7) on U.S. housing and education policy (issues where PRRAC had submitted coalition comments).  Stay tuned for Megan Haberle’s report on the CERD review in the next Poverty & Race, and thanks to the U.S. Human Rights Network for coordinating a successful advocacy effort.

Moldovan Legal Professionals Trained on Fighting High-Level Corruption

From May 4–10, six Moldovan legal professionals attended the Central and Eastern European Law Initiative Institute’s second regional anti-corruption training with support from the ABA Rule of Law Initiative (ABA ROLI). ABA ROLI also selected the Moldovan participants, including two prosecutors, a judge and a National Institute of Justice (NIJ) trainer, who were accompanied by an ABA ROLI staff attorney. A total of 24 lawyers, including from Albania, Bosnia and Herzegovina, Slovakia, Slovenia and Ukraine, attended the Prague workshop.

The interactive course addressed several aspects of investigating high-level corruption, including tracking money, interviewing witnesses, and gathering and presenting evidence. The training employed a case study, allowing participants to work in smaller groups to accomplish various tasks, such as identifying potential corrupt practices, developing an investigation plan, identifying and interviewing witnesses and defendants, analyzing financial data and presenting evidence in court.

Evictions Soar in Hot Market; Renters Suffer

Just after 7 a.m., sheriff’s deputies knocked on the door of the duplex apartment, holding a fluorescent orange eviction notice. The process was quick and efficient. A moving crew began to carry out the family’s possessions and stack them neatly at the curb. Celeste Wilson, the tenant, appeared on the front step in pajama pants.

Ms. Wilson, 36, explained that the family had missed a month of rent when her husband fell ill, so the landlady filed for eviction. Knowing they would be thrown out, the Wilsons had already found a new home, paying a double security deposit and an extra $300 because of the open eviction case.

“It’s the stability I worry about,” Ms. Wilson said, watching her five children trickle out into the yard that had been their playground for five years. “They’ve got to start off fresh, get new friends, new neighbors. It might not show now, but maybe later on in life.”

Opportunity for Service! Northwest Justice Project Accepting Letters of Interest for Its Board of Directors

The WSBA Board of Governors (BOG) is accepting letters of interest and résumés from members interested in serving on the Board of Directors of the Northwest Justice Project (NJP). There are three attorney positions open for three-year terms commencing January 2015 and ending in December 2017. Notice of BOG action will follow its November 2014 meeting.

The Northwest Justice Project is a 125-attorney statewide not-for-profit law firm providing free legal services to low-income people from 17 offices throughout Washington. NJP is funded primarily by the State of Washington and the federal Legal Services Corporation, with additional support from the Legal Foundation of Washington. NJP’s 2014 budget is $22 million.

Board members play an active role in setting program policy, assuring adequate oversight of program operations, and must have a demonstrated interest in, and knowledge of, the delivery of high-quality civil legal services to low-income people.

NJP’s Board is a working board. Board members are expected to attend quarterly meetings in Seattle normally on the last Saturday of January, April, July, and October. Board members also serve actively on one or more standing committees. The Board typically holds a one-day annual Board retreat, which may be held in conjunction with an appropriate equal justice conference. Attorney Board members are expected to participate and support NJP efforts in legal community activities and limited resource development efforts. Travel and lodging expenses are reimbursed, as appropriate.

In Controversial Landmark Resolution, Human Rights Council Takes First Step toward Treaty on Transnational Corporations’ Human Rights Obligations

In a new attempt to hold transnational corporations accountable for human rights violations, the United Nations Human Rights Council has decided to establish a working group to prepare a treaty imposing international human rights legal obligations on transnational corporations. [OHCHR Press Release] The mandate of the working group will be to “elaborate an international legally binding instrument to regulate, in international human rights law, the activities of transnational corporations and other business enterprises.” UN Human Rights Council, Resolution 26/9, Elaboration of an internationally legally binding instrument on transnational corporations and other business enterprises with respect to human rights, A/HRC/26/L.22/Rev.1, 26 June 2014, para. 1.

The expected treaty, when eventually finalized, would be the first international human rights agreement to specifically and explicitly regulate the activities of transnational corporations with regard to individuals’ and communities’ fundamental rights. Previous efforts produced important guidelines and standards, but these are not directly, legally enforceable against business actors. States, however, do have certain legal obligations to regulate corporations and other private actors when their activities impact the enjoyment of human rights.

The decision has triggered mixed responses from the international community. While some civil society groups welcome the new working group, others fear that its mandate is too narrow in scope – by only including transnational corporations – or that it will delay or polarize discussions concerning corporate liability for human rights abuses. Center for Gender & Refugee Studies Announces Release of Pro Se Manual for DV Survivors Seeking Asylum

The Center for Gender & Refugee Studies (CGRS) is pleased to announce the release of our pro se manual for survivors of domestic violence seeking asylum, withholding of removal and Convention Against Torture protection in the United States – available in English, Spanish, and Haitian Creole. We developed this manual in response to a call from advocates, and in recognition of the countless women who are eligible for asylum but due to lack of information and/or lack of access to legal representation, do not receive the protection they deserve. Our release of all three versions of this pro se manual is particularly timely given the refugee crisis at our border, and the thousands of women and girls fleeing domestic abuse in Central America. The manual, available in English, Spanish and Creole, is available for download here.

 

We encourage you to share these manuals widely and to distribute them to local legal aid organizations and advocates in your area. We have also made them available to Legal Orientation Programs (LOPs) with the assistance of the Vera Institute of Justice and are planning to distribute copies directly to immigration detention centers around the country.
