On November 24, 2015, the Vietnamese National Assembly approved a bill to legalize sex reassignment surgery and to introduce the right to legal gender recognition for transgender people who have undergone such surgery.

The law allows people who wish to undergo gender affirming surgeries to do so in Vietnamrather than abroad, and to subsequently change the gender marker on their official documents. This constitutes a small, but significant step toward recognition of transgender people’s rights, Human Rights Watch said today.

Thousands Mourn Kurdish Human Rights Lawyer Killed in Turkey

Tens of thousands of mourners gathered on Sunday to bid farewell to a prominent human rights lawyer whose shooting death delivered a setback to hopes of bringing an end to months of political violence that has swept through Turkey’s Kurdish region.

Tahir Elci, one of Turkey’s leading advocates for Kurdish rights, was killed Saturday after making an appeal for an end to clashes between Kurdish militants and state security forces.

Mr. Elci was shot during a clash on a narrow street in Diyarbakir, the Kurdish majority city in southeastern Turkey that has been one of the central battlegrounds for renewed clashes since a two-year-old cease-fire collapsed in July.

Employers and Workers Grapple with Laws Allowing Marijuana Use

On June 15, 2015, the Colorado Supreme Court was the ultimate buzzkill.

When the state’s residents passed a referendum in 2012 legalizing recreational marijuana use—long after the state sanctioned medical use in 2000—few had any idea that Coloradans who partook in the bud would end up jeopardizing their livelihood.

That’s exactly what the court permitted inCoats v. Dish Network. The case pitted a quadriplegic licensed to use medical marijuana against his employer. The court held the state’s “lawful activities statute,” which generally prohibits employers from firing employees for engaging in lawful activities off the job, applied only to activities lawful under Colorado and federal law. Because marijuana is illegal under the federal Controlled Substances Act, its use isn’t lawful—and can remain a valid basis for termination in the state.

Supreme Court Ruling Could Spark More Unintentional-Discrimination Cases

A recent U.S. Supreme Court opinion that addressed unconscious discrimination in a low-income housing case could have far-reaching effects on future civil rights and criminal cases involving implicit bias.

The June 2015 opinion (PDF) dealt with a claim against the Texas Department of Housing and Community Affairs. It alleged that the department disproportionately gave tax credits to developers of low-income housing in minority inner-city Dallas neighborhoods, while denying the credits in suburbs with large white populations. The Inclusive Communities Project brought the case, alleging that the state agency’s actions led to segregated housing, in violation of the Fair Housing Act.

The Access to Justice Board’s Conference Planning Committee is now accepting proposals for 2015 Access to Justice Conference workshops.  This year’s conference will focus on solutions to address structural impediments to equitable justice and meet the needs of our growing client community.  We encourage and invite you to submit a 90 minute workshop proposal for consideration by the committee.  Proposals should be consistent with the criteria outlined in the attached document.  All workshops will take place on Saturday, June 13, 2015 at the Wenatchee Convention Center.

Proposals must be received by 5 p.m., Friday, January 23, 2015. Submit proposals using the attached form to Terra Nevitt, terran@wsba.org. Electronic submissions only please. Lawyers Fostering Independence Offering Free CLE This Friday

Lawyers Fostering Independence (LFI) provides free civil legal services to young people who have been in foster, group, or kinship care at some point while growing up. With the help of volunteer attorneys, our mission is to improve outcomes for former foster youth by providing them with access to legal services – services that can mitigate the specific adversities experienced by these youth who have been raised in our care.

Our all-day training is on December 5th from 9:00am-3:30pm at Garvey Schubert Barer.

The morning will consist of an introduction to LFI, hearing from former foster youth about their experiences and needs, and our Trauma-Informed Legal Representation CLE (1.5 ethics credits pending). The afternoon will include two training sessions: one on credit and debt issues and the other on sealing juvenile records and vacating adult records. 1.25 CLE credits pending for each of these sessions.

A light breakfast and lunch will be provided.

  • Jacqueline McMurtrie is an Associate Professor at the University of Washington School of Law and the founder and Director of the Innocence Project Northwest (IPNW). The only resource of its kind in Washington State, IPNW’s mission is to exonerate the innocent, remedy causes of wrongful conviction and offer law students an outstanding education. Since 1997, IPNW has obtained exonerations of thirteen men and women who collectively served over 90 years in prison for crimes they did not commit.
  • Fernanda Torres is a Staff Attorney and Volunteer Coordinator at the Innocence Project Northwest (IPNW). She helps oversee the screening and review of applications for assistance and leads the litigation of non-DNA cases. She recruits and supervises IPNW volunteers. Prior to joining IPNW, Ms. Torres practiced criminal defense as a public defender and in private practice.

Significant change, whether individual or within an organization can be challenging. Even when we want to change, it doesn’t happen easily. I recently heard implicit bias compared to a habit, albeit a bad one. Think about how hard it is to change a habit…

A couple of months ago, my brother in law was coming over to my house to pick up his dog after work. We’d talked earlier and he reminded me to leave the front door open for him. Then he sent me a text about 15 minutes before I was leaving as a second reminder. “Leave the door unlocked, leave the door unlocked,” I chanted in my head as I gathered my things to go. Then I went through my mental list of what I needed to bring with me, made sure I had it all, walked out, locked the door and left. His poor dog was locked inside.

Even though I wanted to change that habit and was focusing a lot of mental energy on doing something different, the moment I got distracted, I forgot and went back to what I do every day.

Now imagine there are a bunch of individuals trying to change an organization. But they’ve all learned and practiced habits of stereotypes, biases, and institutional oppression for years. Some have even gotten rewarded for this behavior by being told they’re a “good fit” at the company and getting promoted. Some are the founders of the organization or have worked there so long they see any mention of needed change as a personal affront. Others have been going along to get along, trying not to make waves by bringing up experiences of marginalization. They may even be telling themselves they imagined it or making excuses for oppressive behavior such as, “I know he didn’t mean it that way.”

The Moderate Means Program (MMP) is a UW Law in-house pro bono program that is a great way to get experience interviewing lots of clients without having to leave Gates Hall! The goal of the program is to increase access to civil legal services by people of moderate means who cannot afford an attorney but make too much money to qualify for traditional legal aid services. The program is focused on the areas of Family, Housing and Consumer law.

Law students serving as MMP volunteer interns will interview potential clients by telephone to collect information and evaluate their cases. Qualifying cases will be referred by the MMP interns to participating attorneys who have agreed to represent Moderate Means Program clients for a reduced fee. MMP interns will be expected to commit to a minimum of five hours a week for the duration of spring quarter and this summer (one hour is a weekly staff meeting).

Captured on film by cinematographer Luke Hansen of Albany, N.Y., the outcome of the meeting includes a historic event of profound and lasting significance.

UNHCR Kenya currently comprises a Branch Office in Nairobi and 2 Sub-Offices in Dadaab and Kakuma. The Sub-offices are responsible for coordinating the activities of the refugee camps under their respective jurisdictions. Dadaab hosts mostly Somali refugees while Kakuma is populated by 13 different nationalities including Somalis (53%), Sudanese (34%), and refugees from the Great lakes region.

The Nairobi-based Country Representative is the overall manager of the Kenya program. He is assisted by a Deputy Representative (in charge of operations) and an Assistant Representative for Protection. The Protection Section in Nairobi includes an eligibility and registration center, a protection delivery unit, and a resettlement unit.

Sub-Office Kakuma is managed by the Head of Sub-Office. The Protection, Resettlement, Community Services, Registration, and Eligibility Units are supervised by the Senior Protection Officer (P-4) who is also the head of Protection Section. There are a number of national staff and some international staff working under these protection-related units. In Kakuma the RSD team currently has a staffing capacity of 6 Eligibility Assistants and one RSD Clerk and is faced with an increasing backlog of pending cases due to a steady flow of new arrivals into the camp.

Center for Conflict Studies Offers Peacebuilders Fellowship, Due 3/15

In keeping with the mission of the Center, the goal of the Peacebuilders Fellowship is to give a voice to the voiceless. Fellows will spend around two months in a conflict zone and collect stories of people who have experienced conflict. The hope is that the individual stories will give face to a “distant” conflict, providing empirical knowledge which in turn will empower people to act. Peacebuilder Fellows are therefore, storytellers for peace. Additionally, this supports the Center’s slogan “Knowledge as Action; Action as Change.”

For the year 2014, the Center will be focusing on water conflicts and the Peacebuilders Fellowship will emphasize the gathering of stories of individuals who are stakeholders in a water conflict.  The four regions of focus for the year 2014 are Asia, Latin America, Africa and Middle-East.

The Federal Trade Commission (FTC) is tasked with the prevention of fraudulent, deceptive, and unfair business practices that adversely affect consumers or competition.  In recent years, the Commission’s consumer protection mission has taken on increased international focus as more and more FTC cases involve offshore defendants or assets.  For example, the FTC has sued overseas telemarketers responsible for scamming consumers out of tens of millions of dollars, the FTC has pursued foreign spammers responsible for deluging consumers’ in-boxes with unwanted email, and the FTC has gone after U.S. promoters of bogus weight-loss products who concealed their ill-gotten gains in a maze of offshore bank accounts.

The FTC’s Office of International Affairs (OIA) works to further both the competition and consumer protection missions of the FTC by promoting cooperation with foreign law enforcement and by serving as an internal resource to other Commission offices.  On the consumer protection side, OIA attorneys provide investigative assistance and share information with our consumer protection counterparts around the world, and we assist FTC litigators in other offices with cross-border aspects of their litigation.  OIA attorneys also play a significant role in promoting sound consumer protection policies internationally. Our attorneys have served as consumer protection experts on U.S. delegations to international organizations and foreign agencies, and we have worked with foreign colleagues to produce international guidelines on the identification and prevention of cross-border consumer fraud, on privacy and spam enforcement cooperation, and on consumer dispute resolution and redress.   We also work on international privacy, data security, and e-commerce policy issues that arise in the borderless realm of the Internet, and we share our technical expertise with developing countries seeking to develop and implement an effective consumer protection regime.

The City of Seattle is facing the highest rent increases in the nation which is causing low-income tenants to be displaced at alarming rates, in addition to communities of color being disproportionately impacted. Under the supervision of Kitsap Legal Services’ (KLS) Executive Director and highly experienced volunteer attorneys, interns will serve as part of a countywide team of legal services advocates who work cooperatively with other providers to bring high quality representation to Kitsap County’s vulnerable and low-income population. Substantive priorities may include family law, housing, consumer, bankruptcy, Social Security disability benefits application, and immigration. Interns will experience the realities of a small nonprofit legal services office as they interview clients, direct clients to appropriate community resources or free civil legal advice clinics, or observe and aid attorney in provision of legal services. Interns may also help develop self-help materials for pro-se litigants, training materials for staff and clients and work on other special projects depending on the needs of the office.

Interns will be expected to bring the maturity and commitment to their work necessary to participate as members of a comprehensive, countywide holistic delivery system. Intern skills must include the ability to treat community partners and all clients with compassion, dignity and respect.

The U.S. Department of Education’s Office for Civil Rights (OCR) enforces civil rights laws, including those that protect people from discrimination in educational programs and activities on the basis of race, color, national origin, disability, sex, or age.  We primarily investigate civil rights complaints.  We do not litigate.  We have volunteer internship positions available every semester, especially in the summer months, for motivated students who share our dedication.  Our region handles issues arising in Arizona, Colorado, New Mexico, Utah, and Wyoming.

Interns participate in all aspects of complaint investigations, including local on-site investigations.  Interns make legal determinations regarding OCR’s jurisdiction over complaints; interview witnesses, collect data; analyze data; draft evaluation and resolution letters; and conduct civil rights-related legal research and analysis.  Interns also perform other duties as assigned.

After training, the law clerk will act as the Deputy Magistrate during arraignment hearings one weekend per month.

Attention Post-Grads! Victim Rights Law Center Seeking Two Full Time Staff Attorneys in Oregon, Applications Accepted on a Rolling Basis

Transitional Housing and TA Staff Attorney Position

The Victim Rights Law Center (VRLC), a nonprofit law center that provides free legal services to victims of sexual assault in Oregon and in Massachusetts, as well as legal technical assistance nationally, seeks a full-time, Oregon-licensed attorney to join our team and coordinate the VRLC’s transitional housing partnership. The attorney will provide training as well as legal assistance to sexual violence survivors who are homeless, with a special focus on survivors who are older, Latina or have disabilities. Services to be provided include legal screening and limited legal representation, sexual assault and legal trainings (for both homeless advocates as well as survivors experiencing homelessness) on how to use existing civil laws to meet sexual assault survivors’ needs. The attorney will also help the VRLC’s technical assistance team support lawyers, advocates and other victim service providers in their efforts to use existing civil laws to meet the needs of sexual assault survivors. This position is grant funded. Applicants should have a minimum of three (3) years legal experience, including some litigation practice, as well as experience working with sexual assault survivors and with vulnerable populations. Spanish language fluency is preferred, but not required.

Privacy Project Staff Attorney Position

The Victim Rights Law Center (VRLC) seeks a full-time attorney, with excellent writing, product development and organizational and communication skills, as well as a strong work ethic, a good sense of humor, and a commitment to serving vulnerable populations. Based in our Portland, Oregon, office, the successful candidate will help implement VRLC’s new Privacy Rights Project by conducting legal research, developing resources, creating curriculum, and delivering state and national trainings on the privacy rights of victims of sexual assault, stalking and domestic violence. The Eviction Defense Collaborative seeks an enthusiastic individual to join our team in fighting for tenant rights and saving homes. As a staff attorney you will work with a team of attorneys, interns and volunteers in assisting primarily in pro. per. tenants fight their eviction lawsuits.

The Eviction Defense Collaborative (EDC) provides legal assistance and advocacy to low-income and indigent tenants in San Francisco who are being evicted. We assist by educating tenants about the legal process, advising them of their options, drafting responsive legal documents, providing referrals to assist them in fighting their evictions and negotiating legal settlements. The EDC also administers one-time rental assistance grants and loans to help tenants who are behind in their rent to pay the rent and stay in their homes. The work at the EDC is made possible by a small staff and many volunteers from local schools and the community. The work environment at the EDC is collegial, rather than having a rigid hierarchy of job positions, and we work as a team to assist the tenants who seek our help.

U.S. Department of Veteran Affairs Seeking Summer Intern in Washington D.C., Applications Accepted on Rolling Basis

Professional Staff Group (PSG) VII, the Office of the General Counsel’s Appellate Litigation Division, represents the Secretary before the United States Court of Appeals for Veterans Claims (CAVC). It is the newest and largest group in OGC. With more than 120 persons, the staff includes approximately 70 appellate attorneys and a support staff of paralegals, legal assistants, and copy clerks. A 14-member management team completes the PSG VII staff.

Interns will initially be provided instruction in veterans law, as well as the VA adjudication system. The student will then be assigned a limited case load and will perform research and writing tasks associated with the needs of individual cases depending on their procedural posture. It is expected that at the completion of the
externship, the student will have prepared a pre-Briefing Conference memo, participated in a Briefing Conference, drafted procedural motions, and drafted and filed an Appellate brief with the United States Court of Appeals for Veterans Claims (CAVC). Additionally, the student will be expected to attend and participate in moot
courts in preparation for oral argument before the CAVC.
