Intern duties include: Familiarizing him or herself with the law of expungement, custody, restraining orders, victim advocacy and public benefits in DC, Maryland and Virginia. All training materials will be given to the intern and the intern will receive intensive training on the areas of the law and the civil law process from Amara’s Director of Legal Services. After training, assisting Amara staff attorneys and pro-bono attorneys in general legal research for expungement of records cases, civil cases, criminal defense cases, and victim-witness advocacy. Central America is being hit with an epidemic of Chronic Kidney Disease of nontraditional causes (CKDnT). The population most acutely affected by the epidemic are the sugarcane cutters working in the lowlands of Western Nicaragua. Recent research shows that there is a strong relationship between the sickness and work conditions. Research also shows that many of the same work conditions linked to CKDnT are also in violation of domestic and international laws protecting worker health and safety. For this reason, Profesionales para la Auditoría Social y Empresarial (PASE) has opened a Legal Services Office in Chinandega, Nicaragua focused on serving sugarcane workers, ex-sugarcane workers and their families. The PASE Legal Services Office grew out of a collaboration with La Isla Foundation (LIF), a non-profit organization aimed at tackling CKDnT.

Washington State Pro Bono Council Offering 2014-2015 Access to Justice Policy Internship, Open Until Filled

Volunteer lawyer programs (VLPs) in Washington State have a unique and complex history. Each of the 18 current VLPs evolved in its own way. Several VLPs started as projects of local bar associations, while others were started by groups of attorneys responding to the need in their community. Some programs became stand-alone nonprofit corporations, others became part of community action centers, and three programs remain part of their local bar associations. The local nature of the VLPs is both a challenge and strength.

In response to these realities, the Pro Bono Subcommittee of the Access to Justice Board’s Delivery Systems Committee proposed that a Statewide Pro Bono Council (PBC) be formed to unify and address the needs of Washington’s VLPs – the proposal was adopted in July 2013 and launched in January 2014. The PBC is situated as a committee of the Access to Justice Board.  The PBC welcomes the participation of a law student as an ATJ intern.

The student will be invited to attend PBC meetings, shadow VLP clinics and projects, and be able to work on discrete projects related to the effective delivery of pro bono services in Washington, including one major research project. The nature and scope of these projects will be determined by the PBC, the Manager, and the student as the relationship develops. The research project will involve investigation and analysis of the systemic delivery of legal aid across the state.

Washington Supreme Court Seeking Externs in Winter, Spring, and Summer Quarters – Work with Justice Gonzalez

Justice González is an associate justice of the Washington State Supreme Court, the highest state appellate court.  His externs work under the close supervision of his lead law clerk, Laura Anglin. Externs will review and draft memoranda to the court analyzing and recommending the proper disposition of motions and state habeas corpus (personal restraint) petitions. They will review and make recommendations on bench memos, opinions, and attorney discipline matters. They may assist in the preparation of speeches, CLE materials, rules, and opinions. Externs must be able to both work independently, and work closely with a team, and learn from vigorous copy editing. Considerable research and writing is required.

Uganda Court Annuls Anti-Homosexuality Law

Activists celebrated after the anti-gay law was thrown out, reports Andrew Harding. Uganda’s Constitutional Court has annulled tough anti-gay legislation signed into law in February. It ruled that the bill was passed by MPs in December without the requisite quorum and was therefore illegal. Homosexual acts were already illegal, but the new law allowed for life imprisonment for “aggravated homosexuality” and banned the “promotion of homosexuality”. Several donors have cut aid to Uganda since the law was adopted.

Ugandan government spokesperson Ofwono Opondo said the government was still waiting the attorney general’s advice about whether to challenge the ruling in the Supreme Court. He added that the ruling showed to Western donors that Uganda’s democracy was functioning very well and that they should reinstate any aid they had cut. Continue reading here.

Advocates for Children, Families Oppose Cuts to Services to Fund McCleary

Advocates for children and families have filed an Amicus Curiae brief with the state Supreme Court, opposing one of the Court’s proposed remedies in the McCleary v. Washington case.

The Children’s Alliance, Columbia Legal Services, and the Washington Low Income Housing Alliance filed the brief this morning. The brief requests that, as the state moves to comply with the Court’s ruling, it refrain from funding education in a way that jeopardizes housing and other basic services to children and families. The brief may be found here.

“If we cut social programs to pay for education, everyone’s worse off,” says Paola Maranan, executive director of the Children’s Alliance. “In addressing our failure to uphold kids’ right to a basic education, we don’t want the solution to exacerbate the problem.”

While education must be fully funded, the brief explains how students in low-income families face barriers outside the classroom that prevent them from obtaining a basic education. These barriers also expand the educational opportunity gap that exists between white students and students of color.

In the brief, the organizations explain how, even with the existing level of funding for social programs, students in low-income families and students of color often cannot achieve educational opportunity. Thus, the organizations argue, financing education by cutting or freezing basic services would exacerbate the barriers to education that students in low-income families and students of color already face.

Housing advocates assert the legislature has already cut to the bone funding for both housing and homelessness services. For instance, the State Housing Trust Fund has declined sharply since 2008. This important tool for creating affordable homes received zero dollars this most recent legislative session. Cutting programs could not have come at a worse time, as students in homeless households are at an all-time high. The Office of Superintendent of Public Instruction reported 30,609 homeless students in the 2012-13 school year.

“For children across Washington, the lack of a safe, stable home can be a huge barrier to learning,” says Housing Alliance executive director Rachael Myers. “We already have proven, innovative programs that create affordable homes and keep families and children stably housed. They just need to be adequately funded.”

“Every child deserves an opportunity to succeed,” adds Maranan. “Good nutrition, household economic stability, child care, health care: these help keep kids in school, body and mind.”

Another Amicus brief was filed today by the Washington State Budget & Policy Center and six co-signing organizations. Their brief argues that legislators cannot responsibly fund education without raising new revenue, and that failure to raise revenue will lead to budget cuts that will harm kids’ ability to succeed in the classroom.

The Amicus participants support the Court’s finding in McCleary that the state must provide adequate funding to ensure the right of all children to an education that prepares them for lifelong success.

The Justices of the Constitutional Court of South Africa are pleased to invite applications from outstanding recent law graduates and young lawyers interested in serving as foreign law clerks. Candidates may be appointed to start as soon as 1 July 2014.

Background: South Africa continues to be regarded as one of the most intriguing and compelling examples of constitutionalism in the transition to democracy. Its Constitution is viewed as one of the world’s most progressive founding charters.

The Constitutional Court, the country’s highest court, is the guardian of that promise. It has, in a range of ground-breaking decisions, given content to the Constitution’s guarantees by, for instance, ruling the death penalty unconstitutional; upholding full equality for gay and lesbian people; declaring that resident non-citizens are entitled to social benefits; and ordering the government to make anti-retroviral treatment available to pregnant mothers living with HIV/AIDS.

About the Position of a Foreign Law Clerk: Each year, six to ten young lawyers from around the world serve as foreign law clerks to the Constitutional Court. Working alongside two South African law clerks, foreign law clerks assist a specific judge in performing his or her duties.

The responsibilities of foreign law clerks are essentially the same as those of their South African counterparts and similar to judicial clerks elsewhere in the common law world. These include extensive legal research and writing, as well as the formulation, drafting, and editing of judgments. The Court itself is highly collaborative, allowing for substantial engagement among clerks from all Chambers.

Foreign clerks are generally appointed to serve one six-month term. Some may, however, serve for longer and sometimes in more than one Chambers.

Foreign law clerks are not remunerated by the Court. So, it is essential that they seek their own funding to cover their expenses, including food, accommodation, travel to South Africa, visas and travel to and from work.

Snohomish County Public Defender Association Seeking 1L & 2L Summer Interns/Externs

The Snohomish County Public Defenders Association is seeking  2L Summer interns for  2014 Rule 9 positions and 1L Summer interns for legal research positions.  The Snohomish County Public Defenders Association represents indigent individuals in the Superior and District Courts of Snohomish County.  Currently the office has a Felony unit, Misdemeanor unit, Civil Commitment unit, and a Predator unit.

Rule 9 Positions: The Rule 9 positions will be in the Misdemeanor unit at the office.  Each intern will be paired up with a supervising attorney who will assign tasks as needed. After an initial training period, which will last approximately two weeks, the position will require frequent court appearances, meeting with clients, possible interviews at various correctional facilitates, motions practice, and any other task assigned by a supervising attorney.  The position will likely require a significant amount of time in court.  Only those interested in working with indigent people and who are interested in trial work should apply.  Positions are unpaid.  Externship credit is possible but will require the student to coordinate with the school.

Legal Research Positions: Generally the interns will be responsible for conducting research and writing projects as assigned by a supervising attorney with specific projects coming from any of the above units.  Additionally other projects may be assigned as needed and depending on the interns’ interest.

The 1L interns will go through a portion of the training that the 2L Rule 9 interns will go through.  After that training period the interns will generally be assigned research and writing projects.  These projects will come from, at least historically, all units within the office.

There is one opening for an attorney with Yakima County Department of Assigned Counsel.   Assignment and duties will depend on experience and the needs of the Department and are subject to change. Initial assignment will be in the Juvenile  Court for representation of juveniles in offender proceedings and juveniles in ‘Becca’ proceedings .   Applicants who have at least two years of prior experience and otherwise qualify for a position may be hired in either the Attorney I or Attorney II classification.  The hiring salary range for the Attorney I classification $51,074 – $59,764 per year and the hiring range for the  Attorney II classification is $63,460 to $74,744 per year.  This position is “at will” and serves at the pleasure of the Director of the Department of Assigned Counsel.

Essential Functions: Attorney I positions are given assignments and cases at the entry to moderate level of complexity and seriousness.  Functions listed below are a representative sample.

Criminal Matters:  Provides legal advice and representation for accused at in-custody arraignment proceedings.  Responds to individuals arrested who wish to consult with an attorney at critical stages of proceedings, which may involve on-call rotation work. Interviews and confers with clients regarding facts, plea discussions, trial, sentencing and progress of case. Evaluates each case assessing its factual and legal sufficiency under the law at each stage of a criminal proceeding by reviewing police and other reports and analyzing all information available. Evaluates strengths, weaknesses and facts of each case for purposes of additional investigation, plea negotiations, development of case strategy and trial preparation. Coordinates or conduct case investigation for trial preparation as necessary.  Arranges for tests of physical evidence, testimony of expert witnesses and interview or direct interviews of witnesses as required. Instigates or responds to plea bargaining negotiations with opposing counsel and represent the interest of the client. Represents clients at preliminary appearances, arraignments, pre-trial motions, pleas of guilty, sentencing hearings and post-trial matters such as restitution hearings and sentence reviews/amendments.  Conducts all trial actions, including: selection of jury, opening arguments, direct and cross examination, introduction of evidence and exhibits, preparation of jury instructions, closing arguments and post trial motions.

Civil Matters:  Represents clients at all stages of civil commitment proceedings, Involuntary Treatment Act hearings (mental), child support proceedings, paternity proceedings, contempt proceedings, child dependency proceeding, truancy  and other ‘Becca’ proceedings, and drug forfeiture proceedings. Performs case evaluation, additional investigation, trial preparation, settlement negotiations, pre-trial motions, trials and appeals as required. Performs other job-related duties as required.

The program accepts up to 15 American and British citizens per year. The program includes intensive Russian language training, seminar series, and extended professional experience. Fellows receive a monthly stipend, language training, program-related travel costs, housing and insurance.

The Alfa Fellowship Program aims to expand networks of American, British and Russian professionals, develop greater intercultural understanding, and advance U.S.-Russian and U.K.-Russian relations.

Candidates for the Alfa Fellowship Program must meet the following eligibility requirements:

  • 25–35 years old at the application deadline

Unemployment ClaimsThe Unemployment Law Project (ULP) provides legal representation to unemployed workers of Washington State who have been denied unemployment benefits or whose right to those benefits is challenged.

A “total immersion” experience, the legal intern will work with ULP staff on all levels of client assistance, including client intake interviews, case review, representation at administrative hearings, written appeals to the Commissioner of the Employment Security Department, and possible appeals to the Superior Courts and Courts of Appeal.

The internship is open to law students who have completed their second year prior to the summer of 2014 and to recent law school graduates. The successful candidate will display proficiency in case review and identification of issues, excellent writing abilities and have client intake experience. Although being Rule 9 qualified is not a requirement, being so might open up additional advocacy opportunities.

Interviewing on average two to four potential clients a week, the intern will prepare for and represent clients at an average of one to three hearings a week, as well as meet each of those clients, in person or telephonically, at a pre-hearing conference in preparation for each hearing. The intern will be responsible for identifying the legal issues in assigned cases, researching applicable law, and formulating a written theory of both the client’s and the employer’s case.

We anticipate selecting applicants for two to four unpaid summer law clerk positions lasting approximately ten weeks during the summer of 2014.

OCIG promotes the mission of the Office of Inspector General (OIG) through timely, accurate, and persuasive legal advocacy and counsel. Legal interns will investigate cases, perform legal research, draft briefs, and write legal memorandums. Each legal intern will have an opportunity to work with all three branches of OCIG: the administrative and Civil Remedies Branch, the Industry Guidance Branch, and the Advice Branch. The Administrative and Civil Remedies Branch handles civil fraud and abuse cases involving Medicare, Medicaid, and other programs; works with the Department of Justice in the global resolution of civil False Claims Act cases; initiates administrative cases; and defends the decision to exclude providers from participating in Federal health care programs. The Industry Guidance Branch issues advisory opinions to the public and the health care industry on whether an activity constitutes grounds for sanction under the Anti-Kickback Statute, Civil Monetary Penalties Law, or other authorities, and provides legal advice to HHS and the Department of Justice on the Anti-Kickback Statute. The Advice Branch provides legal advice on issues such as the scope and exercise of OIG’s authorities and responsibilities; investigative techniques, procedures, and conduct; audits and inspections; and the impact of legislative proposals.

Summer 2014 Legal Internship with the Center for Ocean Solutions

Center for Ocean SolutionsThe Center for Ocean Solutions (COS), a collaboration of Stanford University (through Stanford Woods Institute for the Environment and Hopkins Marine Station), the Monterey Bay Aquarium, and the Monterey Bay Aquarium Research Institute, is seeking summer Legal Interns for ten-week positions starting in May or June 2014. The Center’s mission is to solve major problems facing the ocean and prepare the leaders who take on these challenges.

The Legal Intern will work primarily on research and writing projects within the Center’s ecosystem health, climate change, and land-sea interaction initiatives. Legal aspects of this work are likely to include environmental, public lands, administrative, and/or international law. Policy aspects of this work are likely to include monitoring and analysis of key state, federal, and international ocean governance and policy-making activities. Examples of recent Legal Intern projects include:

  • Researching the state of law of cumulative impact assessment under federal and state statutes;
  • Facilitating the use of science-based indicators and thresholds in management under existing statutory and regulatory frameworks;
  • Identifying policy and education opportunities to manage vectors of marine invasive species in California state waters;
  • Researching the impacts of relevant Executive Orders and their funding histories as points of comparison to the recently issued Executive Order on National Ocean Policy;

Urban Justice Center in NYC Hiring Staff Attorneys for Veteran’s Advocacy Project

Urban Justice Center NYCThe Veteran Advocacy Project(VAP) at the Urban Justice Center seeks applicants for a Housing Staff Attorney. The position will focus on litigation and advocacy on behalf of low-income veterans in housing matters. The attorney will be responsible for providing direct legal assistance to veterans in the Supportive Services for Veterans Families program, including representation in Housing Court, at NYCHA hearings, and in advocacy involving HUD-VASH vouchers. In addition, the position will involve work with veterans on minor matters concerning consumer finance, child support, and government benefits. 2 + years of Housing Court litigation experience. Military experience or prior work with veterans is a plus.

They’re also seeking applicants for a Student Veterans Staff Attorney. The position will focus on litigation and advocacy on behalf of low-income veterans, with a focus on those transitioning from the military to civilian life in school.

The attorney will be responsible for providing direct legal assistance to veterans, primarily at higher education campuses around the New York metropolitan area, including representation in public benefits hearings, VA educational benefits claims, consumer finance, and child support. In addition, the position may involve work with veterans on Social Security claims and housing matters. Military experience or prior work with veterans is a plus, including knowledge of the Post-9/11 GI Bill.
