Every year, our Legal Advocate Staff Attorneys provide phone and email assistance to hundreds of people facing diabetes discrimination in every part of the United States. Some are in crisis. They have lost their job, had a child removed from school, or have had a loved one die in detention.

Legal Advocates do not engage in litigation. Instead, they empower individuals to engage in self-advocacy. Legal Advocates identify communication issues and sources of conflict. They give people professional information on their legal rights. They identify practical options for resolving problems, and coach them through self-advocacy action steps. When needed, Legal Advocates provide additional empowerment resources, or connect people to a network of attorneys for direct representation.

The primary role of the Staff Attorney is to zealously represent the client in criminal proceedings, including arraignment, pretrial hearings, trial preparation, plea negotiations, and trial and sentencing. In addition, the Staff Attorney (to the extent possible) is expected to maintain a continuing duty to the client. The Staff Attorney counsels and renders or assists in securing appropriate legal services for the client in matters arising from the original criminal proceedings and maintains contact to ensure the protection of the client’s rights so long as the client remains under court jurisdiction. The Staff Attorney is responsible for the investigation and preparation of assigned cases. The Staff Attorney assists OPD leadership and other staff, as directed, and complies with all legal standards and requirements.

Candidates must be third year law students or recent law school graduates. Additionally, candidates will have demonstrated interest in working with individuals charged with criminal offenses from diverse cultural backgrounds and will have the ability to communicate effectively, both orally and in writing. Demonstrated skill in legal research and writing as well as knowledge of and commitment to the national standards of criminal defense are essential.

University of Pennsylvania Perelman School of Medicine’s Department of Medical Ethics and Health Policy Now Accepting Applicants for Penn Fellowship in Advanced Biomedical Ethics, Due 12/14

The Department of Medical Ethics and Health Policy at the University of Pennsylvania Perelman School of Medicine is now accepting applications for the Penn Fellowship in Advanced Biomedical Ethics. This two-year program seeks to train academic bioethicists who will be future leaders in the field. Fellows will pursue mentored research and a Master of Bioethics or Master of Science in Medical Ethics degree. In addition, they will obtain training and experience in clinical and research ethics.

Eligible applicants must have a doctoral degree (PhD, MD, JD) in hand by May 2016.  Previous work in bioethics is not required.  Applications will be accepted until December 14, 2015.

The Equal Justice Society (“EJS”) is transforming the nation’s consciousness on race through law, social science, and the arts. A national legal organization focused on restoring constitutional safeguards against discrimination, EJS’s goal is to help achieve a society where race is no longer a barrier to opportunity. Specifically, EJS is working to fully restore the constitutional protections of the Fourteenth Amendment and the Equal Protection Clause, which guarantees all citizens receive equal treatment under the law. We use a three-pronged approach to accomplish these goals, combining legal advocacy, outreach and coalition building, and education through effective messaging and communication strategies.

Our legal strategy aims to broaden conceptions of present-day discrimination to include unconscious and structural bias by using cognitive science, structural analysis, and real-life experience. Currently, EJS targets its advocacy efforts on school discipline, special education, the school-to-prison pipeline, and inequities in the criminal justice system.

(i) helping clients resolve the day-to-day problems they face during their incarceration;

The City of Seattle Office of Immigrant and Refugee Affairs promotes a citywide culture that understands and values the contributions of immigrant and refugee communities. It partners with the Seattle Immigrant and Refugee Commission, other City departments, community organizations and members of the private sector to improve services for the Immigrant and Refugee communities and to ensure a consistent implementation of principles of social justice issues. Under Sahar’s lead, OIRA just launched the Refugee Women’s Institute, an innovative program designed to build understanding and trust between refugee communities in Seattle and the Seattle Police Department (SPD). The institute, the first of its kind in the nation, aims to build a grassroots network of refugee women leaders while increasing the cultural competency of the female officers who participate.

Sahar Fathi (JD ’08) is a policy analyst for the Seattle Office of Immigrant and Refugee Affairs. She has served as a legislative aide to Councilmember Mike O’Brien on the Seattle City Council and as a legal clerk for the International Criminal Tribunal for Rwanda. Sahar earned a JD and a Masters in International Studies from the University of Washington, and graduated cum laude from USC with a dual BA in French and International Relations. She attended the Sorbonne Université in Paris, France on exchange, and received a diploma in International and European Law from the Université Jean-Moulin in Lyon, France.

Jennifer Tse, the Western Region U-Visa Coordinator for the Wage and Hour Division of the U.S. Department of Labor will be here to share information about the U-Visa and the Department’s certification process and protocols.

Jennifer Tse is the U Visa Coordinator for the Western Region in the Wage and Hour Division of the U.S. Department of Labor.  Her region covers eight states and three U.S. territories, including Guam, American Samoa, and the Northern Mariana Islands.  In her position as the U Visa Coordinator, she works with exploited workers and makes recommendations whether to certify immigrant victims of labor crimes for immigration relief.  Of the labor crimes, she works especially with victims of trafficking crimes.  Prior to her position with the Department of Labor, Jennifer was an attorney at the Immigrant Justice Project of the Southern Poverty Law Center in Atlanta.  She worked both as an immigration attorney and in litigation primarily involving class-action labor trafficking, workers’ rights, and civil rights cases. She has provided technical legal support and trainings related to immigration relief on behalf of victims of human trafficking, including U and T visas, to federal government officials, national civil rights organizations, advocates, and private firm attorneys.  She is also a member of the White House Initiative on Asians and Pacific Islanders’ Regional Interagency Working Group for Region IX.  A California native, Jennifer received her J.D. from Santa Clara University School of Law and her B.A. from UCLA.

The Seattle Community Law Center provides accessible legal advocacy to people living with physical and mental disabilities so that they may obtain the resources necessary to overcome barriers to financial and medical stability. Simply put, SCLC helps break the cycle of homelessness. Seattle has the highest population of people in Washington living with disabilities that need help with legal problems.  If we want a strong safety net to ensure all people can achieve economic and medical stability, we all have to do our part.

Join us in celebrating and supporting the great work of the Seattle Community Law Center and share a few good laughs at our upcoming 4thAnnual Comedy Fundraiser LOL for SCLC comedy event on Wednesday, November 5th! The show starts at 6:30 and will end around 8:30.  It will be held at Parlor Live! Northwest Justice Project Announces Equal Justice Victory

In a major victory for Limited English Proficient (LEP) communities and access to justice for Workers Compensation claimants, DOJ/DOL have found that L&I policies, practices, and procedures are inconsistent with Title VI of the Civil Rights Act of 1964, the Workforce Investment Act of 1998 and implementing regulations and L&I grant obligations.  DOJ/DOL issued a 33 page decision in response to a complaint filed by NJP on behalf of 8 limited English proficient workers claiming denial of language access by the Department of Labor and Industries – Insurance Services Division.

 

The DOJ/DOL investigation found violations including, the failure (a) to take specific steps to develop, assess, and monitor its Language Assistance Program; (b) to adequately identify the language needs of claimants; (c) to assess the competency and quality of its interpretation services; (d) to ensure that all claimants are provided vital documents and information in a timely manner in a language they can understand, and (e) provide adequate notice of LEP claimants of available language assistance services. Specifically, DOJ/DOL decided that L&I needs to translate vital documents into languages other than Spanish, including Russian, Korean, Chinese, Vietnamese, Laotian, Cambodian and “a few” of the other more frequently encountered languages.  The list of vital documents required to be translated is extensive. 

 

This is a huge victory for all LEP workers in Washington and a major step to obtaining better and more just access to this important worker benefit system, particularly after the Kustera cases, in which the Washington Supreme Court rejected an array of language protections for LEP claimants in the L&I hearing process.  L&I has agreed to work toward developing an adequate language access program with appropriate monitoring and negotiations are underway. 

 

Congratulations to NJP attorneys Kelly Owen, Senior Attorney-Bellingham, Leticia Camacho, NJP-King County, and Patrick Pleas, NJP-Wenatchee, who filed and litigated the extensively documented complaint three years ago, with assistance from Kristi Cruz, NJP-CLEAR.

New Film Decries The Return Of Debtors Prisons

Over the past decade, towns and counties across the United States have been locking up a growing number of people for failing to pay their debts. The American Civil Liberties Union and the Brennan Center for Justice documented the practice in 2010, and Human Rights Watch released the results of its own investigation earlier this year.

Critics have decried the return of the debtors prison, the reviled institution of Charles Dickens’ day. Now, a short documentary, “To Prison for Poverty,” sheds light on a particularly contentious aspect of the story.

In Alabama, Georgia, and other Southern states, many local governments have signed contracts with “private probation” companies — for-profit firms that specialize in collecting fees and fines from people who owe the courts money for low-level infractions, usually traffic-related. Halli Wood, an unemployed 17-year-old from the small town of Columbiana, Alabama, told Brave New Films she was placed on probation with one of the largest of these companies, Judicial Correction Services, or JCS, after she couldn’t come up with the money to pay off a seat belt ticket.

The Employees’ Compensation appeals Board (ECAB), a United States Department of Labor appellate adjudicatory board, is seeking to hire a Law Clerk with a projected start date in May 2014. 

The ECAB, located at the Frances Perkins Building in Washington, D.C., hears appeals taken from determinations and awards under the Federal Employees’ Compensation Act (FECA) with respect to claims of federal employees injured in the course of their employment.  The decisions of the Board are made in accordance with its statutory mandate, based on a thorough review of the case record as compiled by the Office of Workers’ Compensation Programs (OWCP).  The ECAB has final ­authority to determine benefits payable with respect to the disability or death of federal employees injured in the scope of their employment.  There is no further administrative or judicial appeal of ECAB decisions.

The Law Clerk position is a two-year appointment at the GS-11, Step 1 level. The primary responsibilities of the Law Clerk is to review and analyze case records and arguments, conduct legal research, draft decisions and orders, and responses to motions. Familiarity and work experience with the ECAB and its procedures as well as the FECA is most desirable.
