Want to help families of children with disabilities? Come learn about pro bono guardianship opportunities with the Washington Medical Legal Partnership.

The Washington Medical-Legal Partnership (MLP) is an innovative collaboration between medical providers, social workers and attorneys to address the unmet legal needs and improve the health of vulnerable patients and families by integrating legal care into comprehensive healthcare. MLP’s partnership includes Northwest Justice Project, Harborview Medical Center, Odessa Brown Children’s Clinic, Sea Mar Community Health Centers and Seattle Children’s Hospital.

MLP is currently in need of attorneys to advise and counsel families of children with disabilities about preparing for the transition to adulthood, including offering pro bono legal assistance for guardianships. A guardian, usually the parent, is a person appointed by a court to manage the affairs of a person who is incapacitated, often used to ensure continuity of care for a young adults suffering severe mental or physical disability. Once MLP has completed an initial assessment, the family is referred to our pro bono partner.

The pro bono attorney will meet with the family to help them to navigate the judicial process. Guardianships involve filings and a court appearance, but attorneys who do not regularly litigate should find this pro bono opportunity manageable, especially with the support of more experienced attorneys who have already completed guardianship proceedings. The time commitment for a guardianship case can vary depending on the experience of the attorney, case complexity and other factors, but should generally require about 15-20 hours over a 4-6 month period.

This process will be discussed in more detail at the Q&A, where you will hear from MLP and some of the pro bono attorneys about guardianship cases they have handled. Please join us!

This position is a term-limited temporary position (TLT) anticipated to last for two years with a possibility of extending to three years at the pleasure of the appointing authority.

King County leaders have identified the need to reduce the number of adults who cycle through the criminal justice system and to coordinate the County’s multiple on-going efforts to reduce recidivism and improve re-entry of incarcerated adults into the community.

The Recidivism Reduction and Re-entry Senior Project Manager will work collaboratively to build a County-wide strategic approach to recidivism reduction. The position will develop an implementation plan building on King County’s previous and ongoing re-entry plans and programs. Development of the plan will include at least the following activities:   (1) coordinating with internal and external partners to establish shared goals, definitions, and agreed-upon measurements and targets; (2) assisting with an effort to survey and map existing projects and programs that support reduced recidivism and re-entry, including consideration of equity and social justice impact; and (3) identifying additional culturally appropriate and effective strategies to reduce recidivism and improve re-entry, while specifically addressing racial and ethnic disparities in the criminal justice system.  The position may also support grant-funded efforts to improve re-entry in partnership with other agencies and jurisdictions.  Outcomes from this effort are expected to benefit adult jail inmates through better connection with services to meet the needs of incarcerated individuals so they can reduce future involvement with the criminal justice system. The ultimate goal of the work is to stop the revolving door of the justice system through coordination and strategic application of County and community programs. The position will not directly run or manage a program.

DRW is a private non-profit organization designated by the governor and mandated by the federal government to protect the rights of people with disabilities in Washington State. Our mission is to advance the dignity, equality, and self-determination of people with disabilities. We work to pursue justice on matters related to human and legal rights. DRW provides free services to people with disabilities.

Project Description

DRW seeks to host a fellowship focused on improving graduation rates of Native American youth with disabilities attending Bureau of Indian Education (BIE) schools and public high schools.

Washington State Native American students who receive special education services have very low high school graduation rates. They had the lowest graduation rate of all racial and ethnic groups in the 2012-2013 school year – a little over 50% graduate from high school in four years.  Graduation rates for students in special education at Washington State BIE schools ranged from 0% to 60%. This problem affects many youth because Washington is one of the states with the highest population of Native American students and those students are nearly twice as likely to be identified as having a disability as the general student population.

The fellow will investigate the causes of these low graduation rates, collaborate with interested stakeholders, educate Native American students and families about special education rights and self-advocacy steps they can take, and provide advocacy in individual and systemic cases to enforce special education rights of Native American students in order for them to more successfully transition to employment and post-secondary education.

Washington Budget & Policy Center is now accepting applications for the 2014 – 2015 Betty Jane Narver Fellowship. The fellowship is open to any currently enrolled graduate student in a college or university, and recent graduates with a master’s degree or Ph.D.

Qualified applicants should have excellent written and oral communications skills, a commitment to accuracy and attention to detail, and a demonstrated interest in fiscal policy. To achieve our goal of training and supporting new voices in the policy arena, we’re especially interested in candidates from diverse backgrounds.

The fellow will receive a monthly stipend and be responsible for less than 20 hours a week.  This position is not eligible for benefits. Reimbursable travel may be required to specific policy-related trainings chosen by the Budget & Policy Center.  The fellowship will generally run from November 2014 through April 2015 (this is flexible).

President Barack Obama has released a proclamation declaring June as lesbian, gay, bisexual and transgender (LGBT) Pride Month. Check out the excerpt below.

As progress spreads from State to State, as justice is delivered in the courtroom, and as more of our fellow Americans are treated with dignity and respect — our Nation becomes not only more accepting, but more equal as well. During Lesbian, Gay, Bisexual, and Transgender (LGBT) Pride Month, we celebrate victories that have affirmed freedom and fairness, and we recommit ourselves to completing the work that remains.

Last year, supporters of equality celebrated the Supreme Court’s decision to strike down a key provision of the Defense of Marriage Act, a ruling which, at long last, gave loving, committed families the respect and legal protections they deserve. In keeping with this decision, my Administration is extending family and spousal benefits — from immigration benefits to military family benefits — to legally married same-sex couples.

Seattle raises minimum wage to $15 an hour

Martina Phelps says the Seattle City Council’s historic vote Monday to raise the minimum wage to $15 per hour could change her life.

Phelps, 22, earns $9.47 per hour working for a McDonald’s restaurant near downtown. She wants to move out of her mother’s South Seattle home, and she wants to go back to school. She says those things could happen now that the city will have the nation’s highest minimum wage.

“It’s hard right now,” she told USA TODAY hours before the midafternoon vote. “I have been trying to save up for school, but I just can’t do it. This would mean a lot.”

The council unanimously approved the measure before a packed house.

Woman Not Guilty of Chemical Warfare; Constitution Saved

The Supreme Court Monday stepped back from the abyss.

By a vote of 6-3, it refused to invent limits on the federal government’s power to make and enforce treaties.

The case was Bond v. United StatesThis is the second installment of the soap opera of Carol Anne Bond. Bond’s husband and her best friend conceived a child. When she found out, Bond, a trained laboratory technician, turned to the hostile use of 10-chloro-10H-phenoxarsine and potassium dichromate, both deadly poisons. She smeared them on various doorknobs and car doors at Hayes’s house, on one occasion giving Hayes’s thumb a nasty burn. She also unwisely smeared them on Hayes’s mailbox, which is by law part of the U.S. Postal System. Postal inspectors posted security cameras and caught her on video.

Federal prosecutors proclaimed this “a very serious, scary case,” because Bond had stolen four pounds of potassium dichromate from her workplace. They charged her with theft of the mail—and violation of 18 U.S.C. § 229, the Chemical Weapons Convention Implementation Act of 1998.

On Monday a six-justice majority, in an opinion by Chief Justice John Roberts, told the government it had misread the statute to “sweep in everything from the detergent under the kitchen sink to the stain remover in the laundry room,” and “make[] it a federal offense to poison goldfish.” Roberts was joined by Justices Anthony Kennedy, Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor, and Elena Kagan. All nine justices agreed that the government had gone too far in prosecuting Bond. The majority said the indictment violated the statute; Justices Antonin Scalia, Clarence Thomas, and Samuel Alito would have held the prosecution unconstitutional.

Locked Up and Locked Out: How a three-minute joy ride cost one foster youth his AB 12 benefits

When Terrick Bakhit turned 18 while incarcerated in a juvenile correction facility, the foster care system that had watched over him for the previous five years abruptly cut him off.

On June 13, 2012, Bakhit emerged from San Diego County’s Camp Barrett homeless and broke.

“After being locked up for 11 months I felt free, but in the wrong way,” said Bakhit, who was left to fend for himself on the streets of downtown San Diego. “I slept in the rain. I slept on the street. No roof. No house. No nothing. I was stealing food.”

California state law ensures that youths who turn 18 in foster care are eligible for support up to the age of 21 if they choose, to help the transition into adulthood and self-sufficiency. But a small percentage of foster youth can become ineligible for extended benefits if they happen to turn 18 inside a correctional facility without a foster care placement order waiting for them on release.

“If you are incarcerated and don’t have a placement still intact on your 18th birthday, you can’t get benefits,” said Amy Lemley, policy director at the John Burton Foundation, referring to to the benefit foster youth can get after extended foster care benefits.

The problem seems to be rooted in the varying interpretations of state law among counties and the lack of inter-agency communication. Because of the confusion, kids like Bakhit struggle to make ends meet while eligible foster youth continue to receive benefits.

The Moderate Means Program (MMP) is a UW Law in-house pro bono program that is a great way to get experience interviewing lots of clients without having to leave Gates Hall! The goal of the program is to increase access to civil legal services by people of moderate means who cannot afford an attorney but make too much money to qualify for traditional legal aid services. The program is focused on the areas of Family, Housing and Consumer law.

Law students serving as MMP volunteer interns will interview potential clients by telephone to collect information and evaluate their cases. Qualifying cases will be referred by the MMP interns to participating attorneys who have agreed to represent Moderate Means Program clients for a reduced fee. MMP interns will be expected to commit to a minimum of five hours a week for the duration of spring quarter and this summer (one hour is a weekly staff meeting).

Gov. Jay Inslee today appointed King County Superior Court Judge Mary Yu to the Washington State Supreme Court. Yu will fill the seat of Justice Jim Johnson who retired from the court earlier this week due to health issues.

“Judge Yu has distinguished herself throughout her career as someone of great intellect, dedication and compassion,” Inslee said in announcing the appointment at the Temple of Justice. “She has brought to her work, and to her life, a never-wavering commitment to ensuring justice for everyone.

“Her appointment today is a moment all Washingtonians can be proud of.”

Appearing with current members of the Supreme Court, Yu committed herself to working collaboratively with her new colleagues “so the integrity of this institution is only strengthened by our work.”

“Trial court judges, at every level of court, are the workhorses of our system of justice,” she said. “I am proud to come from their ranks and will do all that I can to remember that the trial court remains the place where the law is actually applied to everyday life.”

Big News! Department of Education Guidance Says Transgender Students Protected Under Federal LawTransgender Law Center

Transgender Law Center praised the U.S. Department of Education for releasing guidelines today that make it clear transgender and gender nonconforming students are protected from discrimination under Title IX, the federal law that prohibits discrimination based on sex in schools.

“We hear from hundreds of students each year who simply want to be themselves and learn at school,” said Masen Davis, Executive Director of Transgender Law Center. ”Sadly, many schools continue to exclude transgender students from being able to fully participate. Now, every school in the nation should know they are required to give all students, including transgender students, a fair chance at success.”

Increasingly, courts and federal agencies are making clear that transgender and gender nonconforming people–people who do not conform to stereotypical notions of masculinity or femininity–are covered under laws that protect people from discrimination based on sex.

Consumer Financial Protection Bureau Releases Tools to Protect Foster Care Children From Credit Reporting ProblemsCFPB

The Consumer Financial Protection Bureau (CFPB) today took action to better protect children in the foster care system from credit reporting problems that could compromise their future credit. The Bureau published action letters for child welfare caseworkers to send to credit bureaus if they find errors on the credit reports of the children in their care.

“The Bureau is very concerned about foster care children’s vulnerability to credit reporting problems that can wreak financial havoc for them,” said CFPB Director Richard Cordray. “We want to help ensure that youth leave foster care with clean credit so that they have a firm foundation for their financial future.”

Credit reporting touches the financial lives of nearly each and every American and can be of particular significance to youth in foster care as they are more susceptible to credit problems and identity theft. The nearly 400,000 children in the United States foster care system often lack a permanent address, and their personal information is frequently shared among numerous adults and agency databases.

Landesa Pilots Women First Model in Uganda

The Landesa Center for Women’s Land Rights developed and piloted a model for working with women and their communities to strengthen women’s land tenure security in Northern Uganda. The project significantly improved women’s sense of security of their rights to land.

A total of 250 women participated in the pilot program. One year after the start of the pilot, those women reported an increase in the amount of land they could farm (on average a 3 acre increase) an increase in community recognition of their rights to land, an increased sense of long-term tenure security, and increased awareness of customary justice and dispute resolution mechanisms.  This tenure security can help the women feed themselves and their families, earn income, and helps women achieve direct financial benefits by allowing them to invest in their land to improve their harvests, rent out their land without fear that it will be usurped, sell their land when it is no longer needed, or use the land as collateral.
