The Civil Rights Division of the Department of Justice, created by the enactment of the Civil Rights Act of 1957, works to uphold the civil and constitutional rights of all Americans, particularly some of the most vulnerable members of our society. The Special Litigation Section is one of several sections in the Civil Rights Division. We work to protect civil rights in the following areas:

1) the rights of people who interact with state or local police or sheriffs’ departments;
2) the rights of individuals with disabilities to receive services in their communities, rather than in institutions;
3) the rights of people in state or local institutions, including: jails, prisons, juvenile detention facilities, and health care facilities for persons with disabilities;
4) the rights of youth involved in the juvenile justice system;
5) the rights of people to have safe access to reproductive health care clinics; and
6) the rights of people to practice their religion while confined to state and local institutions.

Professor Joan M. Fitzpatrick was a much loved and universally respected professor of human rights and international law at University of Washington School of Law. She helped establish human rights law as a legitimate field of legal specialization, tackling issues such as protecting refugees, promoting women’s rights, campaigning for gay and lesbian rights, and enforcing human rights during states of emergency. After her untimely death, students of Professor Fitzpatrick, determined to honor their beloved professor and the ideals she stood for, established the Joan M. Fitzpatrick Fellowship in Human Rights as a permanent memorial in her name.

The Fellowship is for a UW School of Law student with a demonstrated commitment to international human rights and an interest in working in the field in the future. The Fellowship award is intended to enable the recipient to travel and work at a nongovernmental, governmental or intergovernmental organization working on human rights and make a significant contribution during the period of fellowship (typically during the summer). The Fellowship is not intended to support research at an academic institution.

The Hotline is part of the City of Seattle’s Bias Hurts Campaign for Seattle residents and business owners who are the targets of discriminatory harassment, including threats, slurs, intimidation and cyberbullying. AG Ferguson to U.S. Supreme Court: Uphold transgender rights

“Late yesterday, Attorney General Bob Ferguson led a coalition of 18 states and the District of Columbia in urging the United States Supreme Court to uphold a lower court ruling recognizing the right of a transgender student in Virginia to use the school bathroom corresponding to his gender identity. The states, co-led by Ferguson and New York Attorney General Eric Schneiderman, filed an amicus, or “friend of the court,” brief in Gloucester County School Board v. G.G.

Gavin Grimm, a transgender student, filed a lawsuit after his school board changed district policy in reaction to some parents’ complaints, barring him from using the boys’ restroom. A federal district court dismissed his claim, but the Fourth Circuit Court of Appeals reversed that ruling and ordered the district court to continue hearing the case. Grimm brought his suit under Title IX of the Civil Rights Act, which prohibits discrimination based on sex.”

The ABA Standing Committee on Legal Aid and Indigent Defendants & The National Legal Aid and Defender Association invite nominations for the 2017 Harrison Tweed Award. The Harrison Tweed Award was created in 1956 to recognize the extraordinary achievements of state and local bar associations that develop or significantly expand projects or programs to increase access to civil legal services for persons living in poverty or criminal defense services for indigents. The award, given annually by the ABA Standing Committee on Legal Aid and Indigent Defendants and the National Legal Aid and Defender Association, is presented during the ABA Annual Meeting at a joint meeting of the National Conference of Bar Presidents, National Association of Bar Executives and National Conference of Bar Foundations.

[World Economic Forum] Many of the migrants who are fleeing their countries are unable to permanently resettle for a number of reasons, including the global underfunding of refugee support programs and national policies motivated by Islamophobia or isolationism. See Amnesty International, Refugees & Asylum. [Slate] Migrants face dangerous conditions and human rights abuses both during travel and once they reach host countries. Given that he has no track record in government and that his cabinet nominees thus far have been openly hostile to the supports—affordable health care, a living wage, robust enforcement of civil rights—that low-income people need most to move out of poverty, our expectations for the federal government under the new administration are at best uncertain. PILA is not the only game in town! The Curtin Justice Fund Legal Internship Program is seeking motivated law student interns to apply for stipends available for summer 2016. The Program will pay a $2,500 stipend to three law school students who spend the summer months working for a bar association or legal services program designed to prevent homelessness or assist homeless or indigent clients or their advocates. The ideal intern will have a demonstrated interest in public interest law and experience working with poor people or on issues affecting them. All law students are eligible, and first year law students are encouraged to apply. The application deadline for Summer 2016 is Monday, March 28, 2016.

Updated Inter-American Commission Report Reviews Gender Equality, Women’s Rights Standards

Containing references to relevant IACHR’s merits decisions and thematic and country reports, judgments of the Inter-American Court of Human Rights (IACtHR), and provisions of regional instruments such as the American Convention on Human Rights, American Declaration of the Rights and Duties of Man, and Convention of Belém do Pará, the report is a comprehensive examination of the standards of the Inter-American human rights system. SeeIACHR, Legal Standards: Gender Equality and Women’s Rights(2015), para. 10.

The Commission welcomed reforms concerning gender equality and women’s rights in Member States and called on them to continue their efforts to improve the situation. However, it also stressed that in spite of these efforts, there are still numerous human rights problems women experience in the Americas, including various forms of violence against women, and discrimination across a wide range of rights and spheres. Department of Justice Issues New Guidance on Preventing Gender Bias in Law Enforcement

The guidance was announced today, Dec. 15, 2015, by Attorney General Loretta Lynch and was a joint effort by the following offices in the Department of Justice: the Office on Violence Against Women, the Civil Rights Division, and the Office of Community Oriented Policing Services (COPS).

Purpose of the Guidance: In partnership with law enforcement leaders and advocates for survivors of sexual assault and domestic violence, DOJ issued the guidance to explain how gender bias can undermine police response to sexual assault and domestic violence and provide a set of principles that, when integrated into police policies, trainings, and practices, will help ensure that police efforts to keep victims safe and perpetrators accountable are not undermined by gender bias.

Today, DOJ issued ground-breaking guidance to law enforcement, aimed at combating gender discrimination in how police address domestic violence and sexual assault. The guidance explains how gender-biased policing is a significant civil rights issue. By issuing the guidance, DOJ is broadening the discussion about policing practices to include a focus on how women and LGBT individuals, particularly survivors of domestic and sexual violence, can be impacted by discriminatory policing.

The Natural Resources Division of the Washington State Attorney General’s Office seeks an experienced attorney with an interest in natural resource management, environmental, contract, and real property law.  This is a project position only funded through June 2017.  The position represents the Department of Natural Resources (DNR) Aquatic Resources Division, the manager of more than 2.6 million acres of state-owned aquatic lands.  This area of practice will involve understanding and applying the state’s Aquatic Lands statutes in RCW Title 79; the State Environmental Policy Act; general principles of property law, including landlord-tenant law; federal law pertaining to watercourse boundaries, navigation, and commerce; environmental law; and the common law pertaining to the Public Trust Doctrine.  The position involves client advice and diverse litigation in state and federal courts and administrative forums.

The Center for Reproductive Rights (the Center) is a nonprofit legal advocacy organization dedicated to advancing reproductive freedom as a fundamental right that all governments are legally obligated to respect, protect, and fulfill.

The Center’s Global Legal Program (GLP) is looking for an enthusiastic, resourceful and highly organized law student intern with a commitment to reproductive rights issues to engage in a variety of legal research and writing projects related to GLP’s fact-finding, advocacy, and litigation in Africa, Asia, Europe, Latin America and the Caribbean, and at the United Nations. This internship, which will be based at our New York headquarters, will provide the successful candidate with experience using legal advocacy and international human rights law to advance reproductive rights around the world.

The internship is full-time, from June 2016 through August 2016.  Interns are encouraged to seek outside funding for their internship.  This internship is eligible for a small stipend if outside funding cannot be obtained.

Eastside Legal Assistance Program Seeking Family Law Intern, Due 12/22

The Eastside Legal Assistance Program (“ELAP”) is looking for a law student to intern in our Domestic Violence Legal Program (“DVLP”) for the Winter Quarter 2016.

ELAP is a non-profit organization that provides no-cost civil legal services to survivors of domestic violence, including related family law issues (such as custody, parenting plans, spousal support, etc.), throughout King County, Washington, and to low-income residents of East and Northeast King County.  The intern will work with staff attorneys in the representation of clients, including providing assistance to draft pleadings and to interview clients, as well as to research points of law.  By the conclusion of the internship, it is expected that the intern will craft a legal memorandum that can be used as a writing sample.

This position will provide experience in practical legal skills such as client interviewing, legal issue spotting, case development, and working with low-income clients.  In addition, the intern will learn substantive and procedural aspects to family law practice, with an emphasis on representing domestic violence survivors. This position is unpaid but can be sponsored for academic credit if available through the student’s school.

This position will develop and manage a new Citywide program to proactively ensure the City’s programs and services are compliant with Title II of the Americans with Disabilities Act and other applicable state and local disability rights laws. This work will include establishing a governance structure to ensure the successful implementation and ongoing operation of the program. AG Shines a Light with Updated Open Governmental Manual

OLYMPIA — Today Attorney General Bob Ferguson announced that his office has updated its online Open Government Resource Manual summarizing Washington’s sunshine laws.

The 2015 publication modernizes the prior manual to reflect the past several years’ developments in the state’s Public Records Act and Open Public Meetings Act, and court decisions interpreting those laws. The manual was last revised in 2007.

For Offenders Who Can’t Pay, It’s a Pint of Blood or Jail Time

MARION, Ala. — Judge Marvin Wiggins’s courtroom was packed on a September morning. The docket listed hundreds of offenders who owed fines or fees for a wide variety of crimes — hunting after dark, assault, drug possession and passing bad checks among them.

“Good morning, ladies and gentlemen,” began Judge Wiggins, a circuit judge here in rural Alabama since 1999. “For your consideration, there’s a blood drive outside,” he continued, according to a recording of the hearing. “If you don’t have any money, go out there and give blood and bring in a receipt indicating you gave blood.”

For those who had no money or did not want to give blood, the judge concluded: “The sheriff has enough handcuffs.”
