Disability Rights Washington (DRW) Releases Documentary about the WSBA’s “Questions of Discrimination”

Disability Rights Washington’s video “Questions of Discrimination” criticizes the Washington State Bar Association (WSBA) exam questions that single out applicants with mental health disabilities and ask for treatment records.

In Washington, as in many other states, several bar application questions and rules call into question an individual’s “character and fitness” to practice law if they have a mental health disability.

According to several law students and attorneys, applicants struggle in answering these questions because they feel forced to choose between their rights to privacy and freedom from discrimination, and their ability to practice their chosen profession.

“WSBA asks a question that’s trying to identify whether or not a lawyer is going to be a problem from a character standpoint. They take kind of a wholesale question like, ‘have you ever been treated for mental health’, that has a built-in assumption that anybody who has ever seen a therapist has a character flaw that might be a problem with them being an attorney. And that’s not borne out by science,” says Andy Imparato, Executive Director of the national Association of University Centers on Disabilities.

Course offerings in the 2014 Duke Law D.C. Summer Institute on Law and Policy focus on topics important to current and aspiring practitioners in fields that require mastery of constitutional, statutory, and regulatory law and policymaking. The two sessions this summer are July 7-17, 2014, and July 21-July 31, 2014.  Each course is designed to provide an accessible introduction to the pertinent legal and policy subject matter. Asian Pacific American Legal Groups Urge Chicago Officials to Investigate Anti-Asian and Anti-Immigrant Video Incident

WASHINGTON — The National Asian Pacific American Bar Association (NAPABA) and its Chicago-based affiliates — the Asian American Bar Association of Greater Chicago (AABA), Chinese American Bar Association of Greater Chicago (CABA), and Korean American Bar Association of Chicago (KABA) — along with the Filipino American Lawyers Association of Chicago (FALA) and the Indian-American Bar Association of Chicago (IABA) express concern over the actions of certain Chicago police officers captured by recently-released video surveillance, which depicts officers using racist and anti-immigrant language during an arrest last summer.

“The actions shown in the video raise questions about how people of color and immigrants, particularly those who are limited English proficient, are treated by Chicago police officers,” said Bill Simonitsch, president of NAPABA. “We urge Mayor Emanuel and Chicago Police Superintendent Garry McCarthy to fully investigate this incident and work with the local Asian Pacific American community to ensure that immigrants and all people of color feel protected by local law enforcement officials.”

According to a lawsuit filed in federal court on May 14, 2014, Chicago police officers verbally harassed and physically abused a Chinese American spa manager during a raid on a local business in July 2013. The security video shows officers entering the spa, apprehending the woman and striking her while she was kneeling and handcuffed. Police officers can be heard on the video making racist and anti-immigrant remarks during the arrest. One officer refused to believe that the woman was an American citizen and told her “You’re not f—— American! I’ll put you in a UPS box and send you back to wherever the f— you came from.”

NAPABA, AABA, CABA, KABA, FALA, and IABA urge the City of Chicago and the Chicago Police Department to fully investigate the specific allegations raised by the video, determine whether any systemic problems of official misconduct exist, and take appropriate action to ensure that all visitors and residents, regardless of gender, race, national origin, immigration status, or English proficiency, feel welcome and safe in the City of Chicago.

Gov. Jay Inslee today appointed King County Superior Court Judge Mary Yu to the Washington State Supreme Court. Yu will fill the seat of Justice Jim Johnson who retired from the court earlier this week due to health issues.

“Judge Yu has distinguished herself throughout her career as someone of great intellect, dedication and compassion,” Inslee said in announcing the appointment at the Temple of Justice. “She has brought to her work, and to her life, a never-wavering commitment to ensuring justice for everyone.

“Her appointment today is a moment all Washingtonians can be proud of.”

Appearing with current members of the Supreme Court, Yu committed herself to working collaboratively with her new colleagues “so the integrity of this institution is only strengthened by our work.”

“Trial court judges, at every level of court, are the workhorses of our system of justice,” she said. “I am proud to come from their ranks and will do all that I can to remember that the trial court remains the place where the law is actually applied to everyday life.”

Big News! Department of Education Guidance Says Transgender Students Protected Under Federal LawTransgender Law Center

Transgender Law Center praised the U.S. Department of Education for releasing guidelines today that make it clear transgender and gender nonconforming students are protected from discrimination under Title IX, the federal law that prohibits discrimination based on sex in schools.

“We hear from hundreds of students each year who simply want to be themselves and learn at school,” said Masen Davis, Executive Director of Transgender Law Center. ”Sadly, many schools continue to exclude transgender students from being able to fully participate. Now, every school in the nation should know they are required to give all students, including transgender students, a fair chance at success.”

Increasingly, courts and federal agencies are making clear that transgender and gender nonconforming people–people who do not conform to stereotypical notions of masculinity or femininity–are covered under laws that protect people from discrimination based on sex.

Consumer Financial Protection Bureau Releases Tools to Protect Foster Care Children From Credit Reporting ProblemsCFPB

The Consumer Financial Protection Bureau (CFPB) today took action to better protect children in the foster care system from credit reporting problems that could compromise their future credit. The Bureau published action letters for child welfare caseworkers to send to credit bureaus if they find errors on the credit reports of the children in their care.

“The Bureau is very concerned about foster care children’s vulnerability to credit reporting problems that can wreak financial havoc for them,” said CFPB Director Richard Cordray. “We want to help ensure that youth leave foster care with clean credit so that they have a firm foundation for their financial future.”

Credit reporting touches the financial lives of nearly each and every American and can be of particular significance to youth in foster care as they are more susceptible to credit problems and identity theft. The nearly 400,000 children in the United States foster care system often lack a permanent address, and their personal information is frequently shared among numerous adults and agency databases.

Landesa Pilots Women First Model in Uganda

The Landesa Center for Women’s Land Rights developed and piloted a model for working with women and their communities to strengthen women’s land tenure security in Northern Uganda. The project significantly improved women’s sense of security of their rights to land.

A total of 250 women participated in the pilot program. One year after the start of the pilot, those women reported an increase in the amount of land they could farm (on average a 3 acre increase) an increase in community recognition of their rights to land, an increased sense of long-term tenure security, and increased awareness of customary justice and dispute resolution mechanisms.  This tenure security can help the women feed themselves and their families, earn income, and helps women achieve direct financial benefits by allowing them to invest in their land to improve their harvests, rent out their land without fear that it will be usurped, sell their land when it is no longer needed, or use the land as collateral.

OIL Appellate attorneys handle removal cases in the Courts of Appeals, and support the Office of the Solicitor General’s immigration litigation efforts in the United States Supreme Court. OIL Appellate provides advice and counsel to United States Attorneys’ offices prosecuting criminal immigration issues that overlap with the office’s civil litigation. OIL Appellate provides support and counsel to all federal agencies involved in the admission, regulation, and removal of aliens under our immigration and nationality statutes, as well as related areas of border enforcement and national security, and participates in public outreach activities, including training, conferences, and publications. OIL Appellate has approximately 260 attorneys and 100 support staff and handles approximately thirty percent of the Civil Division’s caseload.

Students will be assigned to one of OIL’s litigation teams where they will: draft appellate briefs in asylum and cancellation of removal cases and dispositive motions; write case summaries for weekly litigation reports; attend “First Cuts” meetings; and conduct legal research and prepare memoranda.

The Attorney General’s Indian Country Fellowship, Application Opens 7/31, Deadline 9/1

The Attorney General’s Indian Country Fellowship is designed to create a new pipeline of legal talent with expertise and deep experience in federal Indian law, tribal law, and Indian Country issues that can be deployed in creative ways to build tribal capacity, combat violent crime, and bolster public safety in Indian County jurisdictions.

Each Indian Country Fellowship position offers a 36-month appointment that may be extended or converted to a permanent position.  Fellows will generally be assigned to a U.S. Attorney’s Office (USAO) with significant Indian Country work, but may occasionally be assigned to a Main Justice Component with significant equities in Indian Country matters and law.  Fellowship appointments may, at the hiring component’s discretion, be extended or converted to permanent positions without further competition. Friends of Animals is pleased to announce summer (2014) externship opportunities in its Wildlife Law Program (WLP), located in Denver, Colorado. Established in 2013, the WLP fills a niche between animal and environmental activism.  Animal activists often fail to fully utilize the array of local, state, federal and international environmental laws as a means to protect the rights of animals to live free from human interference.  Environmental activists often utilize these laws, but do so to achieve broad environmental objectives that may not always protect the rights of free-living animals. The mission of the WLP is to utilize the law for a singular purpose: to ensure the right of all wildlife to live in an ecosystem free from human manipulation, exploitation, or abuse.

Externs will have the opportunity to get hands-on experience by working closely with WLP attorneys to litigate matters in federal and state court, as well as engage in non-litigation advocacy projects. Typically extern projects include drafting legal documents (60-day notice letters, complaints, discovery documents, briefs, administrative comments), legal research and writing, interviewing and working directly with the client, engaging government decision-makers, and advocating at the policy level. The WLP attorneys also make an effort to expose students to a wide variety of career opportunities, including opportunities in public interest environmental law and animal rights law.

Looking for a Spring Externship? Department of Labor Seeking Spring Extern for OSHA Discrimination Case

The Department of Labor (DOL) recently filed an Occupational Safety and Health Administration (OSHA) discrimination case in federal court.  The DOL Office seeks an extern available in the Spring Quarter who can assist in trial preparation.  If you are interested in anti-discrimination issues, this is a rare opportunity to gain experience in discrimination law under OSHA and Title VII as such cases rarely go to trial.  Externs must be available for at least 16 hours per week, though more hours are available upon request.  If you are interested in the position, please contact Bruce Brown directly by email.  Mr. Brown is the Associate Regional Solicitor for the U.S. Department of Labor’s Office of the Solicitor.
