National Lawyers Guild  Adopts Resolution Supporting Prison Abolition

Following the National Lawyers Guild (NLG) Law for the People Convention in October, NLG membership adopted a resolution calling for the dismantling and abolition of all prisons and of all aspects of systems and institutions that support, condone, create, fill, or protect prisons. The U.S. currently holds the world’s largest prison population at a cost of $80 billion per year, and spends six times more on prisons than education. “Calling for the abolition of this profit-motivated system that is designed to maintain racial and economic inequality while relying on individualized punishment as a primary response to social problems falls directly within our mission of protecting human rights over property interests,” said Sharlyn Grace, NLG Co-Executive Vice President.

Furthermore, the resolution identifies the damaging injustices perpetuated by the current prison system, including racism, classism, ableism, sexism, transphobia, homophobia, ageism, labor abuse, marginalization of non-Christians, and criminalization of political dissent. Prisons legitimize capitalism and feed corporate wealth directly at the expense of poor communities, and especially urban communities of color.

Judge Rules Yakima-Area Hospitals Violated Charity Care Law and Breached Contracts with Indigent Patients

Last week, a Yakima County Superior Court judge ruled in favor of a class of indigent patients against the parent company of Yakima Regional Medical Center (YRMC) and Toppenish Community Hospital. Judge Susan L. Hahn found that the hospitals had a practice of violating the Washington Charity Care Act by failing to screen patients for financial need before demanding payments from patients-many times in the form of up-front deposits as a condition of receiving care. She also found that this practice violated the hospital’s contract with its patients because it caused patients to pay money they did not owe under Washington law.

“All Hospitals have to provide their fair share of charity care, under Washington law,” said Eleanor Hamburger, of Sirianni Youtz Spoonemore Hamburger and one of the attorneys for the class. “By making their obligation to provide charity care a well-kept secret, the hospitals required some patients to pay more than legally allowed for treatment, forced others to go without the medical care they needed, and foisted its responsibility for providing charity care on its closest competitor. Now the Court has concluded that this practice is illegal and a breach of contract.”

2016 Law Student Legal Writing Competition, Due March 4th

The Forum on Affordable Housing and Community Development Law is now accepting writing submission for the 2016 Law Student Writing Competition.

Eligibility:  Open to all students currently enrolled in an ABA Accredited Law School who are members of the Forum on Affordable Housing and Community Development Law

Topic:  Papers should address any legal issue regarding affordable housing and/or community development law.

Submission Requirements: Entries must be original, unpublished work. Articles should be between 25-50 double-spaced pages and should include footnotes in Bluebook format. There is no entry form of any kind. Articles should be submitted in Word format. All author-identifying information should be removed from the article. A separate title page should be attached and must contain the articles title, the students name, and the students contact information including street address, phone number(s), and email address.

Award: Submissions will be blindly evaluated by a committee of Forum members. A single winning paper, as judged by the selection committee, will be awarded a prize of $1,000 and a trip to attend the Forums Annual Conference, May 25-27, 2016, in Washington, D.C. (airfare and lodging included)*. The winner is responsible for any taxes on Fair Market Value (FMV) of full award, including travel, registration and lodging. Winner will be required to submit a completed 1099 as a condition of receiving award.  The decision of the judges is final.

The winning essay may be published in the Journal of Affordable Housing and Community Development Law. If selected for publication, winner will be required to sign a standard publication agreement giving the ABA the right of first publication.

Bridging the Gap is a UW Law in-house pro bono program. The goal of the program is to increase access to civil legal services for people of moderate means who cannot afford an attorney but make too much money to qualify for traditional free legal aid services. The program is focused in the areas of Family, Housing and Consumer law.

Law students serving as Bridging the Gap volunteer interns interview potential clients by telephone to collect information and evaluate their cases. Qualifying cases will be referred by interns to participating attorneys who have agreed to represent clients for a reduced fee. After completing training, Bridging the Gap interns will be expected to commit to a minimum of five hours a week for the duration of fall and winter quarters (one hour is a weekly staff meeting).

Benefits to students:

  • Hands-on experience interviewing clients;
  • Training in substantive legal issues, issue-spotting, interviewing skills and ethics;
  • Instruction on how to use the Legal Server database, which is used by most of the civil legal aid organizations in Washington State, and many other states;
  • Supervision and mentoring by experienced attorneys;
  • The satisfaction of helping low and moderate income individuals who otherwise might not receive any legal help at all;
  • Time spent volunteering for Bridging the Gap counts for recognition with the Pro Bono Honors Society.

GQUAL Campaign to Increase Gender Parity on International Rights Bodies

According to a study conducted by GQUAL, the lack of gender parity, specifically the underrepresentation of women, affects almost all international tribunals and monitoring bodies. They report that women hold only 17% of positions on international courts and 25% of positions on regional human rights bodies. The GQUAL Declaration notes that States are generally responsible for nominating and electing candidates to these international bodies, but often lack transparent guidelines and procedures for such processes. Additionally, most States do not have mechanisms to correct gender disparities. By not respecting the principle of non-discrimination, States Parties may be in violation of Article 8 of the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW).

This annual competition sponsored by the Academy on Human Rights and Humanitarian Law seeks to stimulate the production of scholarly work in international human rights law. The Award in each case will consist of: a scholarship to the Academy’s Program of Advanced Studies, travel expenses to Washington D.C., housing at the university dorms and a per diem for living expenses.

Thomas Jefferson School of Law is pleased to announce the second Jameson Crane III Disability and the Law Writing Competition. Made possible by the generous gift of Thomas Jefferson School of Law alumnus Jameson Crane III, this competition seeks to encourage outstanding student scholarship at the intersection of law and medicine, or law and the social sciences. The competition promotes an understanding of these topics, furthers the development of legal rights and protections, and improves the lives of those with disabilities. Submissions will be judged anonymously by an independent panel of experts.

If you win, you will get a $1,500 cash prize and Thomas Jefferson Law Review (TJLR) will consider the paper for publication under the TJLR’s editorial standards.  Two second place winners will each receive a $1,000 cash prize.  (Preference for these additional winners will be given to submissions from disciplines not represented by the grand prize winner.)

Judge George Bowden Seeks Law Clerk, Open Until Filled

Judge George Bowden presides at the Snohomish County Superior Courthouse in Everett, WA.  The law clerk will stay for a minimum of 1 year and a maximum of 2 years.  The work week is typically 8:30 AM to 4:30 PM Monday through Friday with 10 paid holidays annually.  When the employing judge is on vacation, the law clerk is on “call-in” status to fill-in for other clerks on an as-needed basis. The clerk position also has up to two weeks of paid vacation annually.  Duties include administrative and ministerial duties throughout the week, handling the judge’s schedule and all incoming phone calls, review of legal briefs and preparation of written legal memoranda when the judge is assigned to the civil motions calendar (typically four or more weeks a year).  Medical and dental benefits are provided in addition to the salary of $48,741.

Applications: This is for immediate hire, so Judge Bowden will review resumes and contact selected applicants for an interview as soon as possible. The start date will likely be October 12, 2015, with 1-2 days of training beforehand.

This position is a key member of our program staff and we are looking for someone with the unique ability to articulate how legislation impacts programs and conversely, how programs can be supported with legislation. This person will act as liaison to external stakeholders and seek to collaboratively advance BC’s legislative and policy priorities. They will monitor, analyze and track local, state and federal legislation, regulation and implementation in targeted policy areas. The Senior Manager conducts needed research on federal and state policy, regulatory trends, implementation practices, best practices, and legislation to improve support services, public benefits, and affordable housing for people experiencing homelessness and housing instability. The work of the Senior Manager informs and educates key partners, including policy makers, peer non-profits implementing programs, funders/donors, the business community, advocacy community, the media, and the general public about policy platforms and opportunities for mobilizing our constituents to align funding and policies toward practices proven to end homelessness and increase housing stability. New York University’s Robert L. Bernstein Institute for Human Rights Seeking Clinical/Research Fellow, Due 10/9

NYU School of Law invites applications for a one-year Clinical/Research Fellowship with its Robert L. Bernstein Institute for Human Rights and Global Justice Clinic for academic year 2015-2016. The fellowship will begin as soon as possible, with the exact start date negotiable. The ideal candidate will be an advocate with several years of experience who is eager to work in a combined scholarly-advocacy environment. The incumbent will spend about half of his/her time working on Global Justice Clinic cases and projects and half of his/her time on program development and management for NYU’s new Bernstein Institute for Human Rights. This is not a classroom teaching position.

The Fellow will work closely with Clinic and Institute Director Professor Margaret Satterthwaite, and will enjoy mentorship in human rights lawyering, program management, and applied research. Bertha Fellowship is a two year fellowship for emerging lawyers (0-2 years out of law school) who are interested in gaining both practical experience working on CCR cases and a theoretical understanding of how legal advocacy can create social change. CCR will host four Bertha Fellows, starting in September 2016. This fellowship position requires a two-year commitment from September 2016 to September 2018.

The Fellows will be assigned to work alongside lawyers in one of our three docket areas: (1) Guantanamo Global Justice Initiative; (2) Government Misconduct/Racial Justice; and (3) International Human Rights.  During the course of the fellowship, there may also be opportunities to do work which straddles different dockets.

The Alaska Court System is accepting applications for a Law Clerk to serve a Superior Court Judge in Nome, Alaska. The position will be available August or September 2014 and last one year. The successful applicant will perform research relating to motions before the court; summarize case files; and prepare memoranda and recommendations. The position may also organize files, review case files for procedural sufficiency, review orders and judgments prepared for signature, and assist in the preparation of jury instructions and other duties. After training, the law clerk will act as the Deputy Magistrate during arraignment hearings one weekend per month.

Attention Post-Grads! Victim Rights Law Center Seeking Two Full Time Staff Attorneys in Oregon, Applications Accepted on a Rolling Basis

Transitional Housing and TA Staff Attorney Position

The Victim Rights Law Center (VRLC), a nonprofit law center that provides free legal services to victims of sexual assault in Oregon and in Massachusetts, as well as legal technical assistance nationally, seeks a full-time, Oregon-licensed attorney to join our team and coordinate the VRLC’s transitional housing partnership. The attorney will provide training as well as legal assistance to sexual violence survivors who are homeless, with a special focus on survivors who are older, Latina or have disabilities. Services to be provided include legal screening and limited legal representation, sexual assault and legal trainings (for both homeless advocates as well as survivors experiencing homelessness) on how to use existing civil laws to meet sexual assault survivors’ needs. The attorney will also help the VRLC’s technical assistance team support lawyers, advocates and other victim service providers in their efforts to use existing civil laws to meet the needs of sexual assault survivors. This position is grant funded. Applicants should have a minimum of three (3) years legal experience, including some litigation practice, as well as experience working with sexual assault survivors and with vulnerable populations. Spanish language fluency is preferred, but not required.

Privacy Project Staff Attorney Position

The Victim Rights Law Center (VRLC) seeks a full-time attorney, with excellent writing, product development and organizational and communication skills, as well as a strong work ethic, a good sense of humor, and a commitment to serving vulnerable populations. Based in our Portland, Oregon, office, the successful candidate will help implement VRLC’s new Privacy Rights Project by conducting legal research, developing resources, creating curriculum, and delivering state and national trainings on the privacy rights of victims of sexual assault, stalking and domestic violence. Applicants should have a minimum of three (3) years legal experience, expertise serving sexual assault survivors and/or addressing victims’ privacy rights, and experience creating and delivering engaging, effective, in-person and web-based trainings.

The Eviction Defense Collaborative seeks an enthusiastic individual to join our team in fighting for tenant rights and saving homes. As a staff attorney you will work with a team of attorneys, interns and volunteers in assisting primarily in pro. per. tenants fight their eviction lawsuits.

The Eviction Defense Collaborative (EDC) provides legal assistance and advocacy to low-income and indigent tenants in San Francisco who are being evicted. We assist by educating tenants about the legal process, advising them of their options, drafting responsive legal documents, providing referrals to assist them in fighting their evictions and negotiating legal settlements. The EDC also administers one-time rental assistance grants and loans to help tenants who are behind in their rent to pay the rent and stay in their homes. The work at the EDC is made possible by a small staff and many volunteers from local schools and the community. The work environment at the EDC is collegial, rather than having a rigid hierarchy of job positions, and we work as a team to assist the tenants who seek our help.

U.S. Department of Veteran Affairs Seeking Summer Intern in Washington D.C., Applications Accepted on Rolling Basis

Professional Staff Group (PSG) VII, the Office of the General Counsel’s Appellate Litigation Division, represents the Secretary before the United States Court of Appeals for Veterans Claims (CAVC). It is the newest and largest group in OGC. With more than 120 persons, the staff includes approximately 70 appellate attorneys and a support staff of paralegals, legal assistants, and copy clerks. A 14-member management team completes the PSG VII staff.

Interns will initially be provided instruction in veterans law, as well as the VA adjudication system. The student will then be assigned a limited case load and will perform research and writing tasks associated with the needs of individual cases depending on their procedural posture. It is expected that at the completion of the
externship, the student will have prepared a pre-Briefing Conference memo, participated in a Briefing Conference, drafted procedural motions, and drafted and filed an Appellate brief with the United States Court of Appeals for Veterans Claims (CAVC). Additionally, the student will be expected to attend and participate in moot
courts in preparation for oral argument before the CAVC.
